The process involves creative problem-solving to determine and address the parties' needs and interests rather than to decide upon a winner and a loser, and is therefore more likely to preserve rather than destroy relationships as in litigation. The mediator remains impartial, and does not represent either side or provide legal advice.
The process provides the parties with an opportunity to tell their differing views of the dispute to one another, something they cannot do in litigation which is under the control of a judge and subject to court rules. Although the mediator controls the process, the parties retain control over the outcome of a dispute and are the decision-makers as to whether or not to settle.
